New York Voting Anomalies

Richard Charnin (TruthIsAll)

New Yorkers who post on Election Forums are quite attached to their Lever voting machines. They oppose the installation of electronic voting machines in which the votes can be rigged and the count not verified. And it's understandable when one looks at the mess HAVA created.  They assume that since Levers are not programmable, they are impervious to fraud. Nothing could be further from the truth.

This analysis shows that Kerry did much better in NY than the recorded vote indicates. The question is not if votes were stolen from Kerry; the question is how it happened. Those who claim to “love my Levers” are mistaken to believe that they are foolproof. They cannot verify and prove that their votes were counted accurately.  In fact, historical evidence indicates that Lever machine vote counts are highly vulnerable to rigging – and not just in NY. It’s not a HAVA or Lever vs. Optical-scan issue. The issue is whether NY will have a verifiable vote count.

Victoria Collier wrote about a fraudulent 1970 Florida election in which levers were used in "Votescam"

Many people still in power have yet to be held accountable for their role in aiding and abetting vote fraud. I'll give you two important examples. Famous Miami lawyer Ellis Rubin brought the original Votescam evidence to the Florida assistant State Attorney at the time, Janet Reno. The evidence included the shaved wheels of lever voting machines, forged canvass sheets, and pre-printed vote tally sheets. Reno refused to prosecute, claiming falsely that the statue of limitations had run out on the crime. Years later, Rubin would tell my father that behind closed doors Reno had stated that she could not prosecute. Why? Because she would bring down many of the most powerful people in the state.

In 2000, Gore won nationally by 540,000 recorded votes. But according to the US Census, there were 5.4 million net uncounted votes, of which Gore won approximately 4 million (75%). Therefore Gore’s True margin was close to 3 million. In NY, Gore won by 1.7 million votes (60.2-35.2%) with 4.6% going to third parties. Kerry knew he would win New York easily. But to those who were already planning for Bush’s re-selection in 2004, there could not be a repeat of 2000.  Bush not only needed 270 electoral votes, he also needed a convincing popular vote margin.

Rove knew that Bush could not win a fair election so HAVA was passed in 2002. Touch screens and central tabulators could switch the votes in the battleground states. But New York kept its levers. To pad the popular vote, it made eminent sense to cut Kerry’s margin in states like NY and CA - especially in large urban and suburban locations. Even though Florida and Ohio were the key battleground states, New York was a fertile state for vote padding.

Everyone knew Kerry was going to win NY easily. Winning the popular recorded vote was critical in order to make Bush’s “mandate” appear legitimate. There could not have a repeat of 2000 when Gore won the national recorded vote. In 2004, all indications were that Kerry would do better than Gore in NY and nationally. A massive Democratic registration and GOTV effort would bring at least 500,000 new NY voters. Bush was very unpopular in NY; his approval was much lower than his national 48% rating. So Bush had to find a way to keep Kerry’s margin down in order to get his popular vote “mandate”.

Kerry won the NY recorded vote by 58.5-40.2%, far below his unadjusted exit poll margin (64-35%). The unadjusted vote shares were closely matched even after they were adjusted in the Best Geo and Composite timelines. Kerry’s NY recorded margin was 1.35 million. Kerry’s True margin was reduced by 750,000 votes (a full 25% of Bush’s 3.0m national recorded “mandate”).  How could Kerry have won by just 18% in NY when Gore won by 25%? Where did Bush get his NY votes from? It’s an Urban Legend. Read on.

Even highly regarded experts get it wrong once in a while. Richard Hayes Phillips did a comprehensive analysis which proved that Ohio 2004 was stolen. RHP wrote that the 2004 NY exit poll matched the recorded vote and suggested that it proved the lever machines were accurate (i.e., there was little or no fraud).  But Phillips incorrectly cited the Final NY Exit Poll. Final state and national exit polls are always forced to match the recorded vote – regardless of whether or not the vote count is fraudulent. Phillips should have checked the unadjusted NY State 12% exit poll discrepancy indicated in the Edison-Mitofsky Jan 2005 report.

The Edison-Mitofsky state exit poll timeline shows that the discrepancies declined nationally as they were adjusted for pre-election polls and voter turnout. The New York exit polls only declined from 65% (Best GEO) to 63% (1240am Composite). And then the final exit polls were forced to match the recorded vote. The pristine, unadjusted exit poll data was not released by E-M until Jan. 2005. Their report shows that the unadjusted exit poll discrepancies were greater than those downloaded by Jonathan Simon at 12:22am. The extent of the fraud was much greater than the original estimate – but this was not known until the release of the exit poll report. Yet even the Election Day adjusted exit polls raised many red flags.

To summarize:

Kerry won the NY recorded vote by:  58.5-40.2% (4.31- 2.96m).

There were 7.39m recorded votes.

1) Exit polls (unadjusted and adjusted) showed Kerry to be a 64-35% winner.

2)  In 2000, Al Gore won the recorded vote by 60-35% (4% to Nader).

3)  Returning Nader voters went for Kerry by 3-1.

4)  In 2000, there were 552,000 late (absentee, provisional, etc.) ballots. Gore won 65.4%.

5)  In 2004, there were 499,000 late votes. Kerry won 65.8%.

6)  The National Exit Poll indicated that 10% of Bush 2000 voters defected to Kerry, while only 8% of Gore voters defected to Bush.

7)  Kerry won the majority (57-62%) of new voters.

How does one explain the 2000-2008 New York late vote anomalies?

There were 1.56 million late votes compared to 20.1 million Election Day, a 7.8% increase.

The average Democratic late vote share was 70.2%; the Election Day share was 60.0%.

Gore won 74% of the 483,000 late votes but only 60% of the initial 6.3 million.

Kerry won 66% of the 499,000 late votes but only 58% of the initial 6.8 million.

The unadjusted exit poll had Kerry at 64%.

Obama won 70.7% of the 584,000 late votes but only 62.2% of the initial 7.0 million.

Let’s review the evidence that the NY vote (Kerry 58.5-40.2%) was padded for Bush:

1-  Unadjusted  exit poll: Kerry led by a steady 64-35%

http://www.richardcharnin.com/NewYorkConfirmationKerryLandslide.htm

2- Late votes: Kerry’s share of absentee, provisional paper ballots was 7% higher than his Election Day share (same as Gore and Obama).

http://www.richardcharnin.com/2008LateVotes.htm

3-  Exit poll discrepancy: Levers had a 10.6% WPE, far exceeding other voting machines and Paper ballots (2%)

http://www.richardcharnin.com/2004NewYorkLeverExitPollDiscepancies.htm

http://www.richarcharnin.com/NewYorkLeverFraud.htm

4- Returning voters: Gore had a 60-35% NY margin; third-party (Nader/other) voters broke 3-1 for Kerry (see table below).

5- Urban Legend: Bush’s vote share increased sharply from 2000 in the NYC area with no gain in GOP rural, small towns

http://www.richarcharnin.com/NY2004UrbanLegend62Counties.htm

http://www.richardcharnin.com/TIACountyVoteDatabase_24111_image001.png

6- Election Incident Reporting System (EIRS): Many NYC precincts had broken machines; all “stuck” levers were stuck on Bush. Lever voting machines have given New Yorkers a false sense of security. The 2004 Election Incident Reporting System confirms that Kerry’s winning NY margin was cut drastically by election fraud. There were 19 reported NY 2004 “stuck” lever incidents. All 19 were “stuck” on Bush.

http://www.richardcharnin.com/electionmodel/NY2004EIRS.htm

7- NY 2008 Primary: Zero Votes for Obama in 80 districts. The problem was resolved. But did Kerry also have zero votes go unnoticed in 2004?

Why would BushCo steal votes in NY? Kerry won the recorded vote by a whopping 18%. The simple answer: to pad his popular vote “mandate”. This analysis shows that Kerry did much better in NY than the recorded vote indicates. Naysayers cherry-picked the final NY pre-election poll in an attempt to promote the myth that the exit poll was off. They claimed that the final pre-election poll matched a fraud-free recorded vote. But they can’t provide evidence that the votes were counted accurately. Historical evidence indicates that Lever machines are vulnerable to rigging. They failed to consider absentee and provisional ballots. Dan Rather's voting machine expose illustrated one way that mechanical voting machines were rigged. In Florida  poor-quality paper used in punch card machines was a major cause of election fraud in heavily Democratic precincts.

HAVA Look: A Simple, Verifiable, Open Source Paper Ballot Vote Recording & Counting System

http://www.richardcharnin.com/electionmodel/HAVAOnePC.htm

Thanks to HAVA, elections are vulnerable to multiple vote miscounts: at the precinct level with closed-source, diverse, proprietary code-based touch screens (DREs) and Optical scanners and then on closed-source, proprietary Central Tabulators. They have you coming and going.

On the other hand, paper ballots can easily be input to a standard personal computer spreadsheet. Voters can request a copy before leaving the precinct. The precinct (spreadsheet) file is uploaded to the Internet. The voter can quickly and easily verify his vote as the spreadsheet ballot records are sorted by a unique Precinct/Ballot ID code. At the same time, he can view and/or download the total precinct ballots to verify the vote counts. Consolidation of district/county/state vote counts is tabulated by Open Source software.

Three (3) volunteers input and verify the paper ballots. As Volunteer A reads the ballot, B enters the data and C verifies the result.  Data entry would be completed shortly after the polls closed. The voter fills out a ballot marking each selected candidate's code (i.e. a-Dem, b-Rep, c-Ind). The volunteers use their god-given optical scanners (EYES) to read the ballots and enter the codes in a spreadsheet. As each code is entered, the spreadsheet automatically calculates the total vote and percentage for each candidate.

The following simple steps complete the process: 1) Print the spreadsheet (1 minute). 2) Upload it to the Internet (10 seconds) so anyone can check the precinct results. 3) Upload the sheet to the Central Tabulator (10 seconds). The published totals should match the precinct totals on the Internet and the local PC.

19 “Stuck” Lever Incidents

Six voting machines at site, one down at 7am long lines. The machine delivered was broken, never worked which was one for bldg. itself. People filled out paper ballots on top of cardboard boxes. Voting machine: only one machine for the 8th district at the location; THE MACHINE WAS STUCK ON "REPUBLICAN" and voters couldn't vote unless they were Republican. One of the police officers there looked at the machine and tried to "unstick" it, but was not successful. Voter is concerned that the paper ballots will not get counted, or will be lost.

31489  New York County                    272 First Avenue          Has been happening all morning            2004-11-02 06:40:27 PST

One machine broken, telling people to come back later.  Mostly older people live there.  Telling people to fill out paper ballots but not instructing them how to fill it out, and people doing it incorrectly.  Putting them into a white envelope with red lettering.  He believes it was the provisional ballot - had four check boxes with your situation and none pertained to this situation so people just filling out random box.  Also, not having people fill out voter log, so could come back later and vote again.  All over the board not instructing people which line to wait in, people getting frustrated and leaving.

Voting with write-in, thinks turned the nob incorrectly.  Concerned this might have made her vote not count entirely.

32750  New York County        PS 36; at Amersterdam & 122nd                      2004-11-02 07:47:26 PST

Some of the machines BROKEN, and there is a lot of CHAOS.  Some of the  machines are working, so people can vote on machines.  But long lines and some people are opting to do paper ballots.

33077  Bronx County               PS 105, White Plains Road                   2004-11-02 07:42:17 PST

Machine is NOT BEING RE-SET for each voter; the machine REMAINS ON "REPUBLICAN" and voters have not been able to vote for other parties.  The pol workers said that they cannot adjust the machine because it will jam.

33555  New York        45 Wall Street  11/2  morning   2004-11-02 07:52:57 PST       Hundreds of people and only 1 machine - others working - people are leaving

33629  new york          245 w 145th     8:00     2004-11-02 08:13:23 PST

33682  Bronx County   PS 220, 468 East 140th Street 2004-11-02 08:11:11 PST

The LEVER WAS BACKWARDS on the machine she used, so when she tried to vote, she had to pull it all the way to the other side and the knobs would not move.  When she left the booth, the poll worker pushed a button on the outside.  When she told the poll worker about the problem, it seemed that the machine worked differently after she worked.  She says that the polling site across the street had the same problem -- the machines across the street seemed to have the same problem.

36345  New York        2004-11-02 09:45:23 PST

Machine broke in front of caller.  Ballot did not appear to be official emergency ballot.  Poll worker at table said she wasn't sure the ballots would count.  Long line of people behind me, worried none of those ballots will count.  She didn't know if we should go back and vote when/if problem fixed.

38667  bronx               2004-11-02 11:21:46 PST       Polling place location: 1594 Unionport Road, Parkchester Complex (Parkchester).

This voter called to report the following incidences at his polling place:  (1) at about 7:45 am he was at the polling site in line to vote when the machine broke down.  He saw the emergency ballots and filled one.  However, the poll monitors were not directing any of the voters to the emergency ballots despite the fact that the MACHINE WAS BROKEN. (2) this voter saw other voters who were voting at the same polling place for 20-30 years being told at the polling place this morning that they were supposed to be voting at another location.

Voter voted for president, but half an 'x' showed up in the box but all the other candidates she voted for showed a full 'x'. Machine didn't reflect a full 'x' for President.  She asked poll worker why it didn't show full 'x' and poll worker said it was fine.

The caller went to her polling place and the machines were BROKEN.  The poll workers were extremely disorganized, uninformed, very elderly.  The caller and a number of other voters were handed paper ballots that appear to have been "affidavit" ballots instead of "emergency" ballots.  A poll worker insisted that the ballots provided were the correct ones and that the voters should check of the "one applicable box," none of which were applicable.  The caller and others hand wrote on the outside of their ballots that the machines were BROKEN.  She wanted to report the irregularity.
